Court Orders Man To Remove Criticism Of Cop From The Internet

CAPE GIRARDEAU, MO — The American Civil Liberties Union of Missouri filed a lawsuit today on behalf of a Second Amendment advocate whose free speech rights were violated. Last July, Jordan Klaffer was forced to remove social media postings criticizing a police officer in southeast Missouri.

Klaffer is a gun owner who frequently fires his gun at objects on private property. On May 1, 2013, Jerry Bledsoe, a police officer, confronted Klaffer while responding to a noise complaint. Klaffer videotaped the interaction, where Bledsoe issued an ultimatum to Klaffer to surrender his guns or be arrested. Klaffer refused to give up his guns and was arrested for disturbing the peace.

To express his opinion that Officer Bledsoe was using his position to harass him for exercising his Second Amendment rights, Klaffer posted recordings of the May 1 encounter on YouTube and Facebook. And, on Instagram, he posted a picture of Bledsoe alongside a photo of Saddam Hussein, with the caption “Striking Resemblance.”

Officer Bledsoe retaliated by obtaining a court order that prevented Mr. Klaffer from posting videos, pictures, and text data criticizing Officer Bledsoe on the Internet. “A government order prohibiting criticism of government is the worst kind of censorship,” explains Tony Rothert, legal director of the ACLU of Missouri.

“Gun advocates who fear the government is infringing on the Second Amendment have every right to broadcast their beliefs,” says Jeffrey A. Mittman, the ACLU of Missouri’s executive director. “The ACLU will always push back against government censorship.”

            It is a federal crime to make your own suppressor without prior tax payment and prior permission from the BATFE.

      They made them illegal later than that,I believe in the 60’s because you could buy them in the 50’s at the hardware store.

        Suppressors (aka silencers) became restricted in 1934, as were fully automatic weapons. Search online for National Firearms Act.

        Not sure what hardware store was selling suppressors in the 1950s.

          Found what you are referring to,but that doesn’t change the fact that I remember seeing them in my local hardware store in the fifties.

      Both suppressors and silencers are perfectly legal in most states.

        Suppressors (aka silencers) are legal in most states AFTER sending your fingerprints to the federal government (or setting up a trust to own the suppressor), paying a $200 tax to the federal government, getting permission from your local law enforcement agency, and getting permission from the federal government.

        I wouldn’t call that perfectly legal. I’d call that an infringement. Perfectly legal would be $49 on Amazon.com, or at Walmart.

    If anyone wanted to trivialize the importance of the 2nd amendment, you could do no better than to show this video. This is where confusion sets in for many in the general public.

    Who, in their right mind, would want to shoot guns in a residential area? I would think everyone in the neighborhood would be VERY concerned for a number of reasons. One, the noise. Two, the risk that someone could be accidentally shot.

    There is no question the citizen should have the right to post or say whatever he wants about the police officer, in accordance with 1st amendment rights, but let’s get real here as to why the guys guns were being taken in the first place.

    I think everyone reading this story supports the 1st and 2nd amendments but let’s be logical regarding a person who wants to fire his guns next door in a residential neighborhood.

      There was a time, many years ago, when I lived in a residential area. I can think of no time that I could not jump in my vehicle, and in short order, find an isolated location where it was “safe” to target practice. Granted LEO’s are dangerous and stupid to the extreme, but Klaffer isn’t overly bright either.

        I agree, there is a very disturbing trend with LEOs. (The recent example of the FBI invading Don Miller’s property in Indiana is a good one.) Somehow citizens need to change the direction LEOs have chosen to take. If we don’t we will all be like targets in a target practicing shoot, not knowing even why we are being shot at. I think ALL LEOs should be required to where cameras the entire time they are on duty, no exceptions, and if someone is killed or seriously hurt and the camera is not operating, it should be mandatory prison time for that cop.

      I believe in the right to bear arms against a tyrannical gov’t, but I can’t even imagine having to live next door to this inconsiderate asshole who “frequently” shoots off guns in his yard. As is, I live next door to an asshole who runs a chainsaw & a woodchipper about once a week. Both my neighbor & the guy in the article should be going elsewhere to make their noise and no one should have to put up with listening to it constantly.

      Unfortunately, though, I don’t think this cop would come confiscate a chainsaw…

    The real issue is the censorship. Klaffer is wrong to think the 2A gives him the right to disturb the neighbors. It’s stupid to think you can have a firing range in your backyard when it’s that noisy. Noise ordinances exist for good reasons. Having said that, Klaffer can post anything he likes within the terms of service for his media account. Personally from the video I dont’ see why Bledsoe gave the ultimatum “take your guns -OR- be arrested” . If Klaffer ignores repeated warnings he deserves arrest and anyone who sees the facts can judge his character and his misunderstanding of his rights– no matter what he says on the internet.

    1) well regulated militia> subject of confiscation is NOT in a well regulated militia, 2) security of a free state> subject of confiscation is not aware of issues of state, and 3) keep and bear arms> subject of confiscation owns and fires a gun unsafely on property in proximity to other residents.

    This is the attitude of MOST Americans: belligerent. The extent of their knowledge about the 2nd Amendment is they own a gun, but they have no clue why except it’s a right.

    IF Americans studied the Declaration of Independence and precipitating issues involving it’s formation, including understanding the influence of the Magna Carta on these circumstances, they would know about issues involving the security if a free state. They don’t, because they don’t want to think or take responsibility for this.

    Americans WANT to own guns, but they don’t NEED to own guns. If they NEEDED to own guns they would understand why, and this would reflect in argument with police over confiscation issues.

    In reality, if this alleged victim were militia, he would know better than to fire his weapon in this manner. He’s retarded. I wouldn’t want this going on around me, and certainly I would call the police if it were. Who wants to live near someone live ammo 24/7 who doesn’t seem to have a clue bullets travel through forests, targets and walls? This little fxxkhead isn’t well regulated. He’s UNregulated.

    No argument against the police in this case, because the officer did a lawful confiscation, in my opinion. Posting a rabid comment to Youtube only made it worse for the gun owner, because this is laying out a second level of ignorance which shows this individual is not only immature, he’s motivated for revenge. Why? That’s a mental health issue.

    For an example of what can happen in circumstances like this, take a look at Jeffrey Winehaus (Bulletintman). Alleged victim is a provocateur playing your own ignorance against the reality of gun control. In reality, if you’re going to own and use them you need to understand why. Right now people don’t care about why preoccupied with their McDonald HA HA HA PEE meal OTHER toys.

    1). My Leaf Blower (Very Noisy Contraption),
    2). My Eureka Commercial Vacuum Cleaner (Very Noisy Implement),
    3). My Step-Son’s Mega-Blaster Stereo with Sub-Woofer (Very Booming),
    4). My Axe I’m Chopping Wood With (Oddly the same sound as the “Crack-Crack” of Gun-Fire),
    5). I’m out Back Playing Tennis with John Patrick McEnroe (Tell me HE Doesn’t Disrupt the Peace?)

    So, The Poliz show up & they necessarily maintain congruency & uniformity of law & therefore seize & take away my:
    Leaf-Blower, My Vacuum, My Step-Son’s Stereo, My Axe, & My friend John McEnroe??

    Why not??

    What is the DAMNABLE Fascists Mind-think with regards to “Armaments” & our G*D Given Right To Keep & Bear Our Armaments & the 2nd. Amendment that restricts D*CKS like this supposed “Peace Office” from thinking they have any authority to trend on us??.

    Last time I read about the founding of this Country, any & all “Authority” & “Power” that the Public Servants have or excercise??

    Come from “WE THE PEOPLE”!! We Have the Rights & the Power & the Authority given to us by G*D Almighty & not by some piece of Frickin’ Paper called the “Constitution”.

    The Constitution merely was instituted to enumerate & declare these things & as a LIMITING DOCUMENT UPON THE ENCROACHMENT OF DESPOTIC GOV’T Powers Upon our G*D Given Rights, Authority, & Prerogatives.

    Our Rights as People do not originate nor end with a Piece of Paper….how can you American’s get this so sorely wrong & incorrect??.

    No wonder G*D can’t judge these tyrants…..you American’s are not even acknowledging G*D as your Sovereign ruler and instead adhere to & “Name it & Claim It” all based upon the most REPUGNANT distasteful words I would or could ever utter in L’anglaise: “Constitutional Rights”.

    Imbeciles knowing nothing of the actual basis of your own Country’s Foundation: In G*D & In G*D alone.

    Once you guys figure this out & return/repent for denying G*D on this issue??….then perhaps G*D can Raise up a standard when the enemy comes in like a flood…but in denying G*D, you also limit his ability to defend you as his People…because you don’t acknowledge him??     The right to bear arms has nothing to do with what this guy was being accused of doing! It could have been beating on pots and pans! It could have been a barking dog! It could have been screaming kids! It could have been using a jack hammer on a oil tank! The issue was making loud and disturbing noises that happen to be made my a tool of deadly force. This guy with the gun has the same line of logic as a Muslim cutting out the clitoris of his daughter, and claiming because his religion says the battery, sexual mutilation and torture of his daughter has to be tolerated by the community because his religion is protected. No dumb ass, it is people like you that give more momentum to the ass holes that want guns banned from all citizens, and to only allow agents of government or private security forces to be armed, like black water, Pinkertons and the like. Most cops practice shooting at firing ranges, in the woods hunting deer or birds and have been in the military were they do have gun bans for every place other then in a fire zone(war zone) The pro gun people need to stop the belligerence and stop being goaded into making fools of themselves by calls to action like Adam and Alex. These guys have lots of truths to tell but they can inspire people to get themselves into trouble barking up the wrong tree like this guy did. But I do agree this guy should not be gagged. In truth the judge might also be trying to keep this guy from being subject to a liable or defamation law suit. The ACLU will not be there for him as he gets sued for that.

      Oh and by the way it is not only gun owners with same kind of psychotic logic. All woman own there reproductive tracts, but when they get pregnant, they demand a waver on the law against murder in the first degree. It is called the Roe/Wade ruling, and much like the Muslim father cutting the daughters clitoris out and expecting the community to ignore that girls torture, mutilation and sexual violation the woman demand we ignore the murder of over 55 million American’s that were so young they were murdered either before birth or even at birth (Kermit Gosnell) This kind of mind set of I know my rights of the feminist, the irresponsible gun owners, the racist black, brown, American india and lastly the old stand by the racists white is totally self involved and oblivious to the destruction of humanity they cause.     I do not know either of these men, but the cop in the video seems like one of the good cops that are thought to exist when bad cops are video tapped beating up innocent by standers or worse like the Kelly Thomas murderers. I would not be a bit surprised if the cop in the video is a NRA member or a gun owners of America member. It would be a surprise to me to find out different about the cop that made the arrest. Contrast this cop to the cop in Alabama that gut shot a young Air Force Solder, on his way to his new assignment base. There are so many bad cops so when you see good ones libeled it is just playing into the hands of the powers that be that want only bad cops staffing the force.

    Sounds to me like there is NO ordinance saying he can’t fire his weapons on his property – and noise ordinances only apply at night. So the disturbing the peace charge is bull$hit. Confiscation of his weapons here would be totally illegal. I can’t see them confiscating a jackhammer for operating during the same hours….Handing him a summons to appear in court would be the only legal recourse here. Now I have to admit that where I live it is not allowed to shoot within the village at all – But I am in communist New York State
